Agreement to Terms

By accessing or using LuminaryHD (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Description of Service

LuminaryHD provides a platform for individuals to access their health records through TEFCA-aligned infrastructure. We facilitate secure health information exchange with patient consent.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities that occur under your account

Identity Verification

To comply with HIPAA and ensure security, we require identity verification. You agree to provide necessary documentation and information for this process.

Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload viruses or malicious code
  • Impersonate another person or entity
  • Violate any applicable laws or regulations

Health Information

Your Health Records

You maintain ownership of your health records. By using the Service, you authorize us to:

  • Request and retrieve your health records from healthcare providers
  • Store and secure your health information
  • Display your health records to you through the platform

Consent to Share

When you grant access to a Trusted Partner, you provide explicit consent for them to view specific health records. You can revoke this consent at any time through your account settings.

Fees and Payment

Individual access to your own health records is free. If you are a Trusted Partner, separate pricing and payment terms will apply as outlined in your partner agreement.

Intellectual Property

The Service and its original content, features, and functionality are owned by LuminaryHD and are protected by international copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINARY HD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

HIPAA Authorization

By using the Service, you authorize LuminaryHD to use and disclose your Protected Health Information (PHI) as necessary to provide the Service and as described in our Privacy Policy and Notice of Privacy Practices.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. You may also terminate your account at any time through your account settings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
