How Individual Access Works
Understanding your right to access your health information and how LuminaryHD makes it simple and secure.
Your Right to Access
Under HIPAA, you have the fundamental right to access your Protected Health Information (PHI). This means you can request and receive copies of your medical records, test results, billing information, and other health data held by healthcare providers and health plans.
- Access your complete medical history from multiple providers
- Request records in the format you prefer (electronic or paper)
- Direct your records to a third party of your choice
- No need to provide a reason for your request
How LuminaryHD Simplifies Access
LuminaryHD streamlines the individual access process by connecting you directly to TEFCA's nationwide health information network. No more filling out forms or waiting weeks for records.

Response Timeline
Under HIPAA regulations, covered entities must respond to individual access requests within specific timeframes:
- 30 days for most requests (with possible 30-day extension)
- Immediate to 48 hours for electronic records through TEFCA networks (LuminaryHD's approach)
- Providers must provide records in the format requested if readily producible
Cost and Fees
HIPAA allows covered entities to charge reasonable, cost-based fees for providing copies of health records. However, the fees must be limited to:
- Labor costs for copying (electronic or paper)
- Supplies for creating the copy (e.g., USB drive, paper)
- Postage (if mailed)
- With LuminaryHD: Electronic access typically has minimal to no fees, eliminating paper, copying, and mailing costs.
Your Rights Are Protected
If a healthcare provider denies your request or doesn't respond in time, you have rights and recourses:
- You can file a complaint with the provider's privacy officer
- You can file a complaint with the Office for Civil Rights (OCR) at HHS
- LuminaryHD can help guide you through the process and advocate for your access rights
